Many of the images on this site were created by other persons. As such, any use of these images has copyright implications. However, under the fair use exception to the Copyright Act, a work may be copied for commentary or other non-commercial use. Unfortunately, the fair use exception is notoriously difficult to apply. This site prefers to use the four-factor test set forth by the University of Texas, paraphrased below: |
1. What is the character of the use? Do you wish to use the work for nonprofit, educational, personal, criticism, commentary, news reporting, or parody, or is it a commercial use? |
2. What is the nature of the work to be copied? Is it a factual, published work, an imaginative, unpublished work, or somewhere in between? |
3. How much of the work will you use? Is it a small amount or the whole work? |
4. What effect would this use have on the market for the original if others also copied the work? Is the original out of print or otherwise unavailable or is the copyright owner unidentifiable, or does the proposed use take away from the author's sales? |
